Support Adnan and Emin

Nous, Comité de défense des droits d'Adnan Hadjizadeh et Emin Milli, organisons une manifestation ce vendredi 22 janvier 2010 devant l'Ambassade d'Azerbaïdjan à Paris (78 avenue d'Iena – Metro Charles De Gaulles Etoile) pour la libération d'Adnan Hadjizadeh, Emin Milli ainsi que celle de tous les autres prisonniers politiques arrêtés et détenus sur le fondement d'accusations mensongères.

Le 8 juillet 2009, A. Hadjizadeh et E. Milli, deux blogueurs engagés socialement et politiquement ont été agressés verbalement puis physiquement par deux hommes dans un restaurant.

A. Hadjizadeh et E. Milli, battus et blessés, se sont rendus au commissariat afin de déposer plainte mais, à leur grande surprise, ils ont été placés en garde à vue puis en détention provisoire pour prétendu hooliganisme alors que leurs véritables agresseurs ont été immédiatement relâchés et considérés comme « victimes ».

Le 11 novembre 2009, au terme d'un procès monté de toutes pièces, A. Hadjizadeh et E. Milli, ont été condamnés à respectivement deux ans et deux ans et demi d'emprisonnement.

Ils sont détenus depuis 7 mois à présent.

Malgré un appel de toutes les organisations internationales, ONG, ambassades et collectifs de défense des droits de l'homme, A. Hadjizadeh et E. Milli n'ont pas pu bénéficier d'un procès équitable et resteront emprisonnés encore deux ans.

Nous sommes réunis aujourd'hui pour demander qu'il soit immédiatement mis fin à cette injustice.

Nous demandons l'abandon immédiat des charges fictives dont ils font l'objet et leur libération immédiate ainsi que celle de tous les autres prisonniers politiques détenus en Azerbaïdjan.

A 15 heures, le 22 janvier 2010, Paris participera à une série de manifestations organisées à travers le monde pour la libération des "donkey blogueurs" Adnan Hadjizadeh et Emin Milli.

Les deux jeunes vidéoblogueurs ont été condamnés, le 11 novembre 2010, par le Tribunal du district de Sabayil à Bakou, à deux ans et demi (Emin) et deux ans (Adnan) d'emprisonnement ferme pour prétendu hooliganisme.

Les blogueurs ont fait appel de ce jugement.

L'audience en appel aura également lieu vendredi prochain, 22 janvier 2010.

Tandis que les supporters d'Adnan et Emin assisteront au procès à Bakou, nous nous réunirons à Paris devant l'ambassade d'Azerbaidjan, 78 avenue d'Iena à Paris (16ème)

On 1 October 2009, Elnur Majidli, representing the Alumni Network (AN Network) in France, and the Chairman of the Committee of Human Rights, Chingiz Ganizade, met with High Commissioner for Human Rights of the Council of Europe, Thomas Hammarberg.

Current human rights issues in Azerbaijan were discussed during the meeting held at the central office of the Council of Europe in Strasbourg.

Among these issues, the focus was on the arrest of young bloggers Emin Milli and Adnan Hajizada, political prisoners and factors preventing the effective development of democracy in the country.

Chingiz Ganizade emphasized the importance of the High Commissioner’s support in these matters, emphasizing the poor situation of democracy in the country. He then requested the Council of Europe to intervene in the human rights field in order to assist in the improvement of the current situation.

Introducing himself as a representative of the AN Network, Elnur Majidli talked about the illegal arrest of one of the network’s co-founders Emin Milli and of the co-founder of the OL! [Be!] Youth Movement Adnan Hajizada. He also stressed the importance of the Council of Europe’s support in securing their release.

Thomas Hammarberg said that he is informed about the current situation in Azerbaijan and is seriously concerned about bloggers’ (Emin Milli and Adnan Hajizada) arrest.

The High Commissioner also mentioned that the Council of Europe is following the trial attentively and that this case is one of their main concerns in Azerbaijan.

Referring to the existence of problems with national minorities in Azerbaijan, Hammarberg voiced his doubts regarding the death of the director of the Talish Cultural Centre Novruzali Mammadov, who passed away in the prison.

Chingiz Ganizade objected that there are no problems with national minorities in Azerbaijan and that Novruzali Mammadov as well as other journalists have been arrested for their political activity rather than their belonging to a national minority.

To the question of the High Commissioner as to which issue should be followed most closely in Azerbaijan, Chingiz Ganizade answered pointing out the existence of political prisoners.

Observing that since the 18 March 2009 Constitutional Referendum Azerbaijan has increasingly moved away from democratic principles, Elnur Majidli cautioned against the growth of serious threats to freedom of expression in the country and reiterated that the arrest of the two young bloggers was due to their exercising the right to free speech.

The release of arrested journalists was also touched upon during the meeting.

Thomas Hammarberg said that he will be visiting Azerbaijan at the beginning of 2010 and that he will discuss the above-mentioned issues during his meetings with State officials. During his visit, he is also planning to meet with NGOs working in the field of human rights and democracy.

Tomas Hammerberqin Avropa Şurasının mərkəzi binasında yerləşən ofisində baş tutan görüşdə Azərbaycandakı insan haqlarıyla bağlı problemlərin mövcudluğu müzakirə olunub.

Qarşılıqlı müzakirə şəklində keçən toplantıda başda bloqqerlər Emin Milli və Adnan Hacızadənin həbsi olmaqla, siyasi məhbuslar məsələsi və ölkədə demokratiyanın inkişafına maneçilik törədən amillərə toxunulub.

30 dəqiqəyə yaxın davam edən görüşdə Çingiz Qənizadə ölkədəki demokratik vəziyyətin ürəkaçan olmadığını qeyd edərək baş komissarın dəstəyinin vacibliyini vurğulayıb. Azərbaycandakı insan haqlarıyla bağlı problemlərə toxunan Qənizadə, Avropa Şurasının mövcud vəziyyətə müdaxiləsini istəyib.

Elnur Məcidli, görüşdə AN şəbəkəsini təmsil etdiyini bildirərək AN şəbəkəsinin yaradıcılarından biri olan Emin Milli və OL Gənclər Hərəkatının fəalı Adnan Hacızadənin həbsinin qeyri-qanuni olduğunu və hər iki bloqqerin azadlığa buraxılması üçün Avropa Şurasının dəstəyinin əhəmiyyətini qeyd edib.

Tomas Hammerberq, söhbət əsnasında Azərbaycandakı hazırkı vəziyyətlə bağlı məlumatı olduğunu və bloqqerlər Emin Milli və Adnan Hacızadənin həbsinin ciddi narahatlıq doğurduğunu bildirib.

Azərbaycanla bağlı əsas diqqət etdikləri məsələnin gənc bloqqerlərin həbsi olduğunu bildirən baş komissar , məhkəmə prosesini diqqətlə izlədiklərini söyləyib.

Azərbaycanda milli azlıqlarla bağlı problemlərin olduğunu söyləyən Hammerberq, Talış Mədəniyyət Mərkəzinin rəhbəri Novruzəli Məmmədov həbsxanada vəfat etməsinə şübhəli yanaşdığını bildirib.

Çingiz Qənizadə isə Azərbaycanda milli azlıqlar problemi olmadığını, Novruzəli Məmmədovun və digər məhbusların milli azlıq olduğuna görə yox, siyasi fəaliyyətinə görə həbs edildiyini vurğulayıb.

Baş komissarın Azərbaycanda insan haqlarıyla bağlı əsas hansı məsələnin diqqət mərkəzində olması gərəkdiyi sualına Çingiz Qənizadə siyasi məhbusların mövcudluğu olaraq cavab verib.

18 Mart referendumu ilə Azərbaycanın demokratik prinsiplərdən bir az da uzaqlaşdığını ifadə edən Elnur Məcidli, ölkədə söz və ifadə azadlığının qarşısında ciddi əngəllər olduğunu və hər iki bloqqerin də öz fikirlərinə görə həbs olunduqlarını bir daha qeyd edib.

Görüşdə eyni zamanda həbsdə olan jurnalistlərin azadlığa buraxılması məsələsinə də toxunulub.

Tomas Hamerberq, 2010-cu ilin ilk aylarında Azərbaycana səfər etməyi planlaşdırdığnı və səfəri zamanı qeyd olunan problemlərə toxunacağını və rəsmi görüşlərlə yanaşı, insan hüquqları və demokratiya sahəsində çalışan QHT-lərlə də görüş keçirməyi istədiyini söyləyib.

On July 23, 2009, the Sabail Court rejected the complaint of Adnan Hadji-Zadeh and Emin Milli regarding the conditions of their police custody on July 8. The same Court, confirmed by the Baku Court of Appeal, had previously stated their detention on remand.

Let it be reminded that on July 8, Adnan Hadji-Zadeh and Emin Milli were victims of an aggression in "Livan" restaurant in Baku. When they wanted to complain to the police, they were kept in police custody for the whole night and prevented from meeting their lawyers or parents. Despite their injuries, they could receive no medical care (excepted for cotton to wipe Adnan's broken nose). Furthermore they were immediatly put in detention and charged with hooliganism relying on no serious ground.

This situation was denounced by all international organisations and NGOs, as well as human rights defenders in Azernaijan.

Notwithstanding the support of civil society, Azerbaijani government has persisted in presenting Adnan Hadji-Zadeh and Emin Milli as trouble-makers, turning the victims into aggressors and aggressors into victims and calling on the international community not to interfere.

As a result, the two videobloggers will remain in unlawful pre-trial detention for two months.


Support to Adnan Hadji-Zadeh and Emin Milli definitely must go on and be enhanced.

Actually, due to a regrettable misunderstanding of information, some people think the procedure will be over within two months (i.e. now one month and 13 days) and consequently consider any further action as hopeless.

In fact, the situation is much more serious and far from for being over.

We are in front of a complicated judicial battle.

Legally, they will have to face and confront at least 3 proceedings.

1. The proceeding about pre-trial detention :
Adnan and Emin have already been detained in pre-trial detention on the pretext that "they could try to run away" during the investigation period.
This Sabail Court's decision, confirmed by the Baku Court of appeal, is clearly groundless and violated national and European provisions.
As a result, the lawyers of the two youngsters declared their intention of filing a complaint before the European Court on Human Rights (ECHR).
It must be stressed that the pretrial detention can be extended until the judgement stating they are innocent or guilty.

2. Regarding the police custody :
The police custody of Adnan and Emin was arbitrary and also violated the defence right, as they were not allowed to see their lawyers and family, and were not provided medical care.
However, the Sabail Court rejected their complaint, that's why this proceeding will probably also be submitted to the ECHR.

3. Regarding the charges of hooliganism :
At the present time, "investigation" (!) is still conducted.
I would like to draw everybody's attention on this issue.
This proceeding is the most serious and important one.
Adnan and Emin, charged for "hooliganism", are facing a 2-5 years imprisonment sentence.

The danger is really high and the supporting movement must be continued and enhanced during this process even if it could be long and complex.

Keep fighting for Adnan Hadji-Zadeh and Emin Milli, and support the Azerbaijani youth that is struggling for the implementation of democracy in their country.

Just remember: If you keep silent, it does not mean you are inactive. Being silent means showing the Azerbaijani Government that its repressive policy, by violating fundamental rights and being pityless, is the right strategy for eliminating the free-speaking citizens.
